Is the UK Preparing to Reintroduce an Investor Visa?

Although no formal policy announcement has yet been made, the proposal has generated considerable interest within the immigration, private wealth and investment sectors. If implemented, the new route could mark a significant shift in UK immigration policy and potentially fill a gap that has existed since the closure of the Tier 1 Investor visa in February 2022.


Background: Why Was the Previous Investor Visa Closed?

The UK's former Tier 1 Investor visa, often referred to as the "golden visa" route, was closed to new applicants on 17 February 2022. The Home Office stated that the route had given rise to security concerns and was being closed as part of wider efforts to tackle illicit finance and strengthen the integrity of the immigration system.

Prior to its closure, the route generally required applicants to invest a minimum of £2 million in qualifying UK investments and provided a pathway to settlement for investors and their family members.

The closure of the route left the UK without a dedicated immigration pathway specifically designed for high-net-worth individuals seeking residence through substantial investment.


Why Is a New Investor Visa Being Considered?

The UK remains one of the world's leading destinations for investment, offering political stability, a globally recognised legal system, world-class universities and access to international markets.

However, many competing jurisdictions continue to operate investment migration programmes designed to attract wealthy individuals and their capital. Reports suggest that policymakers are exploring whether a carefully regulated investor route could strengthen the UK's competitiveness while addressing the concerns that led to the closure of the previous scheme.


What Could the New Investor Visa Look Like?

While details remain speculative, reports indicate that the proposed route may differ substantially from the former Tier 1 Investor visa.

Higher Investment Thresholds

Unlike the previous route, which required investments of £2 million, reports suggest the new visa could require a minimum investment of approximately £5 million.

This would position the route as a premium immigration pathway aimed at individuals capable of making significant contributions to the UK economy.

Invitation-Only Applications

The visa may operate on an invitation-only basis, restricting eligibility to applicants who meet specific economic, commercial or strategic criteria.

Such an approach would allow the Government to exercise greater control over who may access the route.

One of the principal criticisms of the former investor route related to concerns regarding the origin of investment funds.

The new route is expected to include significantly enhanced source of wealth and source of funds checks, together with more rigorous due diligence requirements designed to ensure transparency and compliance.

Investment into Priority Sectors

Rather than permitting passive investment, the Government may require applicants to direct funds towards sectors considered strategically important to the UK economy.

These could include:

  • Technology and innovation;

  • Artificial intelligence;

  • Life sciences;

  • Clean energy;

  • Infrastructure;

  • High-growth businesses; and

  • Other priority industries identified by the Government.

Exclusion of Passive Investments

Reports suggest that passive investment categories, including residential property and other assets with limited economic impact, may be excluded entirely.

The focus appears to be on investments capable of generating economic growth, innovation and employment.

Ongoing Compliance Requirements

Applicants may be required to demonstrate not only that investments have been made, but also that they have been maintained and continue to deliver economic value throughout the duration of the visa.

This would represent a more active compliance framework than previous investor immigration routes.


A More Integrated Approach to Immigration and Financial Regulation

Another notable feature of the reported proposals is the apparent intention to align immigration policy more closely with anti-money laundering measures, financial crime prevention and tax compliance.

This reflects lessons learned from the operation of the former Tier 1 Investor route and signals a more sophisticated regulatory approach to investor migration.


Potential Pathway to Settlement

Reports indicate that successful applicants could receive an initial period of three years' residence in the UK, with the possibility of extending their stay and eventually qualifying for settlement, subject to meeting the relevant requirements.

However, no official details have yet been published regarding residence requirements, extension criteria or eligibility for indefinite leave to remain.

At present, the proposed investor visa remains the subject of media and industry reports rather than formal Government policy.

No Statement of Changes to the Immigration Rules has been published, and the Government has not confirmed whether a new investor route will ultimately be introduced. Consequently, the precise eligibility requirements, investment criteria and route to settlement remain uncertain.

Nevertheless, the emergence of these proposals indicates that the Government may be reconsidering the role of investment migration within the UK's wider economic and immigration strategy.
